Clare Turnbull, RTMA, ETMA, MITMA, Partner

UK and European Trade Mark Attorney based in Tunbridge Wells, Kent

Clare has over a decade of experience advising on trade mark and design matters.

She began her career as an Associate of the Association of Law Costs Draftsmen, which gave her an insight into the cost of litigation, and the benefit of avoiding the courts when possible by using legal protection pro-actively – like registering trade marks!  She left that profession following the Woolf reforms, which made the legal cost drafting profession much less collegiate, and trained as a trade mark attorney.  In 2007 she joined Brookes Batchellor as an associate trade mark attorney, and in 2011 she joined the partnership.

Clare was awarded a prize for gaining the highest mark in her trade mark practice papers.

Clare has a particular interest in non-conventional marks. She provides practical and pragmatic advice with an eye to the commercial concerns of her clients.

Recent work

Acting for the owner of a rare three dimensional mark, Clare recently overturned several objections on absolute grounds, forcing the Registry to concede that it could not withdraw a filing date once it had been given.

Qualifications

Associate of the Association of Law Costs Draftsmen (AALCD)
Registered Trade Mark Attorney, European Trade Mark Attorney

Clare at a glance

Loves about the job:
The variety of both the work and clients and the attention to detail required. I have found a profession where pedantry is positively encouraged.

Would rather be:
Skiing.

Fantasy dinner party guests would be:
A Frenchman, an Irishman and an Italian, so I could listen to them talking – about what I don’t really care.

People would be surprised to know:
I can upholster a piece of furniture, using traditional methods, from the bare frame to the top fabric.

In another life, would have been:
A barrister. Law is in my blood.
